Gender discrimination and sexual harassment can and do exist outside of the workplace. Title IX is a federal civil rights law that simply states “No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” The Noble Law’s New York office is proud to provide representation for those in New York State who believe they need legal assistance in handling matters related to sex discrimination.
What is Title IX?
The 1972 ratification of Title IX is frequently associated with increased access to sports for women at the college level. However, the scope of issue areas covered goes beyond college and is much broader than athletics. Some of the additional areas protected include:
- Admissions, recruitment, and financial assistance
- Sexual harassment, assault, and violence
- Treatment of pregnant and parenting individuals
- Discipline and employment
Individuals dealing with a potential Title IX case should know their options. One option is filing an administrative complaint with the Department of Education’s Office for Civil Rights. The other option is to pursue private legal action by retaining an attorney. Our New York attorneys offer private, confidential consultations to discuss the specific nature of your matter. Who Benefits from Title IX?
Title IX is not a wordy statute, but it does have wide applications for a range of individuals. Students, faculty, and staff who are part of an educational institution are all eligible to be covered by Title IX protections. It also applies to more than just institutions of higher learning. Any federally funded school, including elementary schools, middle schools, and high schools, is under the obligation to be in compliance with Title IX.
For example, all federally funded institutions are required to respond quickly and effectively to reports of sexual assault on their campus. Once an incident is reported to school officials, it must be promptly responded to and an investigation must be opened. Additionally, there must be documented procedures for handling sexual violence, and resources need to be available to support victims.
